TERMS AND CONDITIONS
The terms and conditions written on this page concern firstly Fabien Abric, registered under the number 84341428500018 of the « Registre du Commerce et des Sociétés d’Occitanie » (the trades and companies register of Occitanie), hereafter called « Ucuetis Spray Paint Art » and owner of the website https://ucuetis.com, and secondly, any natural person or legal entity likely to make a purchase on the website https://ucuetis.com, and hereafter called « the buyer ».
Article 1. Subject
The aim of these terms and conditions is to determine the contractual nature of the exchanges between Ucuetis Spray Paint Art and the buyer, as well as the conditions that apply to any purchase made on the website https://ucuetis.com.
By making a purchase on this website, the buyer accepts these terms and conditions – which he will have carefuly read before ordering – without reservation.
Before any transaction the buyer asserts firstly, that the purchase of goods on the website https://ucuetis.com has no link to a professional activity and is limited to a strictly personal use, and secondly, that he has the legal capacity to subscribe to these terms and conditions.
Ucuetis Spray paint Art reserves the right to change these terms and conditions at any time, in order to comply with any new legislation, or to improve the use of its website. Therefore, the terms and conditions that apply to a purchase are those in use at the date of the purchase.
Article 2. Products
The products for sale are those featured on the website https://ucuetis.com. They are subject to stock availability. Ucuetis Spray Paint Art reserves the right to change the selection of products for sale at any time. Each product is presented on the website with a written description of its main technical features. The photos are as close to the real items as possible, however items may differ from photos. The seller will not be liable for any difference between the photos and the actual items.
Items featured on the website https://ucuetis.com will only be sold to citizens of countries that fully allow the import of such items.
Article 3. Prices
All the prices featured on product pages are in Euros and all taxes included, including the VAT in effect at the time of the order. Any changes in VAT will impact the prices of the products. Ucuetis Spray Paint Art reserves the right to change these prices at any time, provided that the price indicated on the day of the order remains the price in effect for the buyer. Prices do not include shipping costs, which will be added to the price of the prodcuts purchased, depending on the total amount of the order. A ten euros (all taxes included) flat rate for shipping will be added to the buyer’s order. Any additional fees (customs fees, etc) are the buyer’s responsibility.
Article 4. Order and payment
Safe online payment via Paypal or by Credit Card (via the Paypal gateway) :
First, the buyer adds the items he wishes to buy to the « basket ». If needed, he can change the contents of the basket (product quantity and references). Then the buyer checks the shipping address or enters a new one. The shipping costs are calcutlated and indicated to the buyer, as well as the name of the carrier service. Next, the buyer chooses a payment option : Paypal checkout. The buyer is then asked to check all of his information, to read and accept these terms and conditions by ticking the designated box. Next, he is asked to confirm his order by clikcing on the « Place order » button. Lastly, the buyer is redirected to the Paypal gateway where he can safely enter either all of his Paypal account details or his credit card details. If the payment is accepted, the order is officially placed and the sales contract is definitively concluded. The Paypal or credit card payment is irrevocable.
By confirming an order, the buyer accepts these terms and conditions, admits to perfectly knowing their content and therefore renounces to his own terms and conditions.
The information provided as well as the order confirmation and placement will be prooth that the transaction has taken place. If the buyer has an email address and has provided it when placing his order, Ucuetis Spray paint Art will send him a confirmation email for his order.

Article 5 Title retention clause
Ucuetis Spray Paint Art retains the full ownership of the products sold until the complete payment has been processed and received, taxes and fees included.
Article 6. Right to cancel
According to article L.121-20 of the « Code de la Consommation », the buyer has a fourteen business days legal period from the delivery to assert his right to cancel his order and thus return the product to the seller in exchange of a refund, with no extra fees but shipping costs. However, personalized or specially made to order products shall not be taken back.
Article 7. Shipping.
Products are shipped to the address indicated on the order form, which can only belong to the agreed geographical area. Orders are shipped through the French Post (« La Poste ») using the « Colissimo » registered signed for shipping service. The shipping times indicated are only informative. If they were to exceed 60 days counting from the placement of the order, the sales contract would be terminated and the buyer would get a refund. Ucuetis Spray Paint Art can provide tracking information to the buyer via email. The parcel will be delivered to the buyer’s address by his local postman. If the buyer is not at home, a delivery notice will be left in his mail box. The buyer will be able to pick up the parcel at his local post office by providing said delivery notice as well as an ID, for a period indicated by postal services. Ucuetis Spray Paint Art is not responsible for any loss or damage caused by post services. Therefore, Ucuetis Spray Paint Art will not be responsible if the product undergoes damage after leaving the Ucuetis Spray Paint Art Office. The buyer is expected to check the state of the parcel and its contents with the postman or delivery man. If damage happened during transport, any complaint should be filed against the carrier services within a three days time from the delivery.
Article 8. Warranty.
All products provided by Ucuetis Spray Paint Art are protected by the legal warranty of articles 1641 and beyond of the « Code Civil ». Should a product sold be non-compliant it could be returned to Ucuetis Spray Paint Art, who would take it back, exchange it or provide a refund. Any complaints, exchange or refund requests have to be sent to the following email address : ucuetis@ucuetis.com wihtin 30 days from the delivery.
Artilce 9. Liability
Within the framework of online sale,the Ucuetis Spray Paint Art Company only has to provide best endeavour. It will not be liable for any damage caused by the use of the Internet such as loss of data, hacking, virus, connexion problems and other unvoluntary problems.
Article 10. Intellectual property.
All elements of the website https://ucuetis.com are and remain the exclusive property of Ucuetis Spray Paint Art. It is strictly forbidden to reproduce, exploit or use, even partially and for whatever the reason, the elements of this website, whatever the shape they come in (logo, photos, texts…). These rules also apply to the designs of paintings you may have bought.
Article 11. Privacy
Ucuetis Spray Paint Art commits itself to keep any information provided by the buyer and that it would be required to collect and share with legal services, confidential. All information concerning the buyer is subjected to the law n°78-17 of the 6th. Jan. 1978. Therefore, the Internet user has a right to access, change or delete any information concerning himself. He can ask for access to his personal information at any time by writing to ucuetis@ucuetis.com
Article 12. Dispute resolution.
These terms and conditions are subjected to the French Law.
